Re: Interesting Things
Date: 2024-10-05 11:34 pm (UTC)Writing a thing involving some fictional businesses; became distracted by q of where they sat with laws on anticompetitive practices. Read around and this made me laugh:
https://www.skadden.com/insights/publications/2021/07/distribution-duel-uk-and-eu-competition-reforms
"Here's a product. Please sell it for us. We can't tell you how much we recommend it should cost, and you can't tell us how many you're selling, or under what circumstances. We're just going to drop our products into a black hole and hope for the best."
I assume the people writing the proposals got there from trying to think what was best from the end customer's pov, assuming that max isolation between competitors was always best and would end up making things cheapest, while forgetting that in this case the supplier and retailer's fortunes depend on each other? but lol.

in order to measure the retail market share correctly, it is necessary to include not only the supplier’s products, but also all competing products. In order to assess its legal position under the block exemption, the supplier would therefore need access to up-to-date and detailed information on the performance of its buyers in terms of competing products. It is the Distribution Law Center’s view that this could trigger a requirement for information exchanges which the current drafts may consider anti-competitive.
Absolute genius.
